The AI Powered Growth System provides marketing automation, AI-driven communication tools, CRM setup, SMS/email automation, reputation management, lead generation funnels, and related digital marketing services for contractors and small businesses.

We reserve the right to modify, suspend, or discontinue any portion of the Service at any time without prior notice.

3. No Guarantee of Results

While we strive to improve lead generation and business growth, we do not guarantee specific revenue increases, lead volume, rankings, or business results. Performance depends on multiple external factors including market conditions, competition, and client participation.

4. Client Responsibilities

Clients agree to:

  • Provide accurate business information

  • Maintain legal compliance in their industry

  • Respond to leads in a timely manner

  • Use the system ethically and lawfully

  • Obtain proper consent before sending SMS or email communications

You are solely responsible for compliance with TCPA, CAN-SPAM, and other applicable marketing and communication laws.

5. Payments & Billing

All fees are outlined in your service agreement or invoice.

  • Payments are due as agreed.

  • Late payments may result in service suspension.

  • Subscription services may renew automatically unless canceled in writing.

  • All fees are non-refundable unless otherwise stated in writing.

6. Intellectual Property

All software configurations, automations, funnel designs, workflows, branding elements, and proprietary systems remain the intellectual property of AirChief Aerial Solutions, LLC unless otherwise agreed in writing.

Clients may not copy, resell, distribute, or replicate system architecture without written consent.

7. SMS & Communication Compliance

By using our system, you agree:

  • You will only send messages to contacts who have provided proper consent.

  • You will honor opt-out requests immediately.

  • You understand messaging fees may apply based on carrier rates

AirChief Aerial Solutions is not liable for misuse of messaging tools.

8. Limitation of Liability

To the fullest extent permitted by law, AirChief Aerial Solutions, LLC shall not be liable for:

  • Indirect or consequential damages

  • Loss of revenue or profits

  • Data loss

  • Business interruption

Total liability shall not exceed the amount paid for services in the previous 30 days.

9. Termination

We reserve the right to terminate or suspend services if:

  • Terms are violated

  • Payments are not made

  • Illegal or unethical use is detected

Upon termination, access to systems and automations may be revoked.

10. Third-Party Platforms

Our services may integrate with third-party platforms (e.g., CRM providers, SMS carriers, hosting services). We are not responsible for outages, policy changes, or limitations imposed by those third parties.

11. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. We implement reasonable safeguards but cannot guarantee absolute security of digital data.

12. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.
